You're leaning heavily into philosophy here. Be careful to remain true to the period, not whether something is fair or not by our standards. Check out George Garnett's short history of the Conquest and look for the August 2013 special issue of Past and Present edited by Jenny Benham for a fantastic collection of articles on the authority of written law and lawmakers in the Early and Central Middle Ages. Benham's book Peacemaking in the Middle Ages: Principles and Practice, (Manchester, 2011) would also be worth reading if not as directly relevant.

You're still analysing an event but the emphasis is contextualisation by reference to contemporary thought, not modern thought.
