I'm not 100% sure what you mean by "formed in the government." American political parties are technically non-governmental organizations and exist outside of the government. I think what you are referring to is the qualification for federal financing for a third party candidate if they passed the 5% mark in the previous presidential election.

Since Perot did indeed pass that mark in the 1992 elections, he qualified for and received federal public funding for his 1996 Presidential Campaign.

Now you may note that the Reform Party is not currently a major party in American politics. That is a complicated and interesting tale.
