In the case of Canada, at least (I know little about settlement of the U.S.), contrary to the myth that the land was wrested from Native peoples by conquest, much of it was acquired through treaties. These are legal contracts between the English Crown and various sovereign aboriginal nations. The treaties were incorporated into the Constitution when it was patriated to Canada from England in 1982 - so Canada is now essentially a signatory to those contracts.

These treaties are varied, and were signed over a long span of years, and I am no expert on them, so I won't try to delve into their specifics. But by and large they are supposed to be Nation-to-Nation contracts, and were entered into by the First Nations (Natives) with the understanding that they were agreeing to share the land with the settlers and in exchange would receive various goods and services. There is a strong feeling amongst First Nations that the Crown, and subsequently Canada, has failed to uphold their end of the bargain. Thus the land was stolen; in the same way that you might consider goods or service to be stolen if you weren't paid an agreed-upon price.
