So the other day my uncle was telling me this theory about how back in the colonial/early america days men at the age of 18 and up were forced to own a gun and participate in their local militia and do drilling and all that and were fined if they did not own a gun. He then told there are some who think that because of this they made the part of the 2nd amendment making it a right to bear arms was actually intended to not FORCE people to own guns and actually served more as a right NOT to bear arms (as in have the choice rather than be forced) . I have been trying to do a bit of googling but haven't really found anything about this theory online and am not really sure what to type in my searches.
Has anyone else heard of this or have any thoughts on it?
So what your uncle is telling you is partly true. During the Colonial era, many parts of Colonies, especially those dealing with Native Americans did have large militias. In many places, especially during the American Revolution, being in the militia for men ages 16+ was mandatory -- although often times people could offer up a "muster tax" in lieu of active participation. However, this wasn't something every American male had to deal with, especially since many communities (especially in the South) did no openly support the war.
That said, I've never seen a single state or colonial law that required firearm ownership. Firearms were expensive -- many times prohibitively expensive for many working class Colonials. As a result, some militias, such as several in Connecticut and Massachusetts stored firearms at a centered locations and were actually publicly owned.
