Did Silesia leave the Holy Roman Empire?

by Sataniel98

I was reading a Wikipedia article and stumbled upon this section:

Translation:

"The First Silesian War ended with the Preliminary Peace of Wrocław and the Peace of Berlin in 1742. According to the treaty, the Duchy of Lower Silesia and the County of Kladsko were given 'in full souvereignty and independence ... from the crown of Bohemia' to Frederick. He gained Silesia with the bindings of Imperial feudal laws being repealed."

Is this accurate? Does that mean Prussian Silesia was not part of the Holy Roman Empire anymore as of 1742? I have never read anything about this being the case before, and the maps I know that show the late HRE don't exclude Silesia. Plus, it was definitely part of the German Confederation, where at least usually only the former parts of the Empire were included.

Sorry for the late response!

To clarify the treaty words, essentially, the region of Silesia was ceded to Prussia. To expound on it, the terms where Lower Silesia was given full sovereignty from was from the crown of Bohemia, then under Archduchess Maria Theresa.

Due to this transfer of land, the Imperial laws (laws promulgated by the Holy Roman Emperor/Empress) were now repealed and from then on, the laws of the Prince-Electorship of Brandenburg-Prussia apply to the ceded land. Do note that this switch between effective laws of the land is due to the terms of the Privelegium de non Appellando which I explained here.

To summarize, Prussian Silesia was still part of the Holy Roman Empire when it was transferred to Prussia due to the Treaty of Berlin, though since the transfer was from the fiefs of the Holy Roman Emperor to a Prince-Elector of the Empire, the Imperial Laws that once governed Silesia needed to be repealed as the laws of the Prince-Electorship of Brandenburg-Prussia would be applicable to Prussian Silesia instead.
