I ask because as far as Nazis go, Rommel always pops up as one of the more neutral ones, who wasn’t outlandishly evil and actually had some respect from Allied forces. Plus, would his alleged involvement in the plot to assassinate Hitler potentially have brought him any clemency?
So, basically, what charges if any would the Allies have laid against Rommel if he lived to the Nuremberg trials?
There is a primary source, the United Nations War tribunal transcript of the sessions that they called the German High Command Trial. In it, it’s evident that Rommel was in contravention of many articles. Here are examples using three articles under which other Field Marshals were convicted:
Crimes against peace for the invasion of France, crimes against the convention of warfares (to do with the treatment of POWs and the facilities in which they must be detained), and then treatment of civilians. Rommel most definitely would have failed those because he provided support in Poland for a power that created the ghettoes and concentration camps. It’s important to remember that he was Hitler’s friend and got his desert command for his fidelity and effectiveness in invading Poland and France.
Additionally, here is a quote on how labor can be used during war that showed Field Marshals were not guilty of everything they were charged with, helping us contextualize the trials as more than mere witch hunts where they were assumed guilty of anything they could find:
“ Another charge against the field commanders in this case is that of sending prisoners of war to the Reich for use in the armament industry. The term ‘ for the armament industry ’ appears in numerous documents. While there is some question as to the interpretation of this term, it would appear that it was used to cover the manufacture of arms and munitions. It was nevertheless legal for field commanders to transfer prisoners of war to the Reich and thereafter their control of such prisoners terminated. Communications and orders specifying that their use was desired by the armament industry, or that prisoners were transmitted for the armament industry are not in fact binding as to their ultimate use.”
