If the 13th Amendment allows slavery as a punishment for a crime, why didn't Southern states just pass laws that incriminated black people for frivolous reasons in order to keep them in slavery?
I'm assuming the reason why this "loophole" in the 13th amendment didn't work is due to the massive amount of black people elected into office directly after the civil war.
