Has an individual ever been convicted of Genocide based on "Imposing measures to prevent births in the group"?

by an_evil_eskimo

I'm currently researching Article 6 of the Rome Statute and looking for practical examples of the provision surrounding the prevention of births, but the databases for the ICC and Rwandan and Yugoslavia tribunals are not working for me.

Has there been an example of a genocide conviction based on the provision, or has it remained unused?

I'm not aware of any criminal charges being laid in Canada or in the international legal system, but an argument could be made that Canadian authories engaged in this form of genocide in the twentieth century. Some provinces passed forced sterilization acts in the 1960s that led to at least 1150 Indigenous women being sterilized without their consent, and often without their knowledge, up until the mid-1970s.

This, of course, was occuring at the same time as the so-called "sixties scoop," where child welfare services seperated Indigenous children from their families, and in the immediate aftermath of the Indian Residential Schools system. Taken together, these policies are now recognized to consistute a campaign of genocide against Indigenous peoples by the Canadian state.
